Default I have a question regarding a deal made here

This is what happened. I purchased a sub from a member on this site the sub was destroyed in shipping by ups. I contact the seller and tell him he contacts ups they come get the sub. Afterwards they deny the claim lose the sub according to the seller.Then the seller tells me to file a paypal claim to get my money back. This is where my problem starts it has already been more than a month I have been patient waiting. I started a paypal claim they say there waiting on the other partys response. Should I start a buyer beware thread?What should I request the the seller to do? If the guy spent the money what will happen? Never had to deal with this bs before and it's starting to become a pain in the ass. What would you guys do.

It's the sellers responsibility to ensure there is sufficient packaging for the item to reach the buyer safely. If UPS denys the claim it is still on the seller to refund the buyer and there should be no need for the buyer to file a paypal claim as the seller has the option to refund the money through paypal. It sounds like something fishy is going on. If you paid using a credit card or debit card through paypal I would call them to file a charge back because if you file a claim through paypal and the money is out of his account then they will do nothing for you.

he's already taken the money out so paypal will screw you first. do the chargeback.

For reference -- you can lose your Paypal account by going to the credit card company.

Well I will contact paypal on the phone because the amount of money is not worth permantly screwing myself with paypal I have at least 750.00 coming this month so 255 is not worth losing the account

if UPS denies the claim, if he had insurance he can file a reclaim with the insurance company. btw UPS never accepts the claim. the insurance company is Crawford, they usually send the shipper a paper to call and send pics and description of the damages. this process took over 3 months for me when I tried shipping my Snap-On tool box.

While it may be possible it is not 100%. I've had to file chargebacks in the past when using paypal and my account is still fine.

I called paypal described the situation gave them the tracking number as soon as they checked it they said has been sent to ups and is in the sellers possesion paypal refunded the money. so now it's up to the seller to deal with the shipper and I have pics if he request them for the shipper.If you have problems call paypal it worked for me.

ups has very strict rules when it comes to personnally packed items.

must have atleast 2" of packaging around entire item.
Also if ittems weight more tha 70lbs it must be double boxed as well. Learned the hard way on that.

also on the paypal claim. paypal values its customers, you should receive your moneyback. as you did not receive what you payed for, in the condition discribed.
seller is solely responsible for shipping damage if it is due to poor packaging.
