I've never gotten a definitive answer about picture number 2. The mounting screws are pushing down the gasket material. Is that bad for the driver?

you are right, but not really bad for the sub, just a bad seal because it wasnt down as tight at possible, ive recently switched it to where the bolts are now hidden tucked under the gasket

You definitely want the screws/bolts to be under the gasket, directly on top of the frame. Screws or washers over the rubber gasket will not seal or secure the sub properly.
